By using this site and making use of FigLeaf, a software offered by FigLeaf App Inc. with its principal place of business at 2549 Waukegan Road # 850 Deerfield, IL 60015 (hereinafter referred to as "FigLeaf" or "Company"), You agree to abide by the following Terms of Service ("Agreement"). These Terms of Service cover all present and future features offered by your Figleaf account, individually and collectively referred to as the "Software".

You can also review our Privacy Policy, which outlines our practices towards handling personal information that you may provide to us.

This Software is provided exclusively to individuals who are at least 16 years of age.

Descriptions of the functionalities

Scan for breaches — Knowing if your personal info is out there is the first step to taking control of your privacy. FigLeaf digs deep to find out if your emails and passwords are floating around online, publicly or on the dark web, so you can take steps to stay private. Once you know if your info is exposed for others to see, you can change your password and keep others out of your accounts.

Mask new accounts — Signing up somewhere new? FigLeaf gives you a virtual email address to use instead, along with a strong, randomly generated password. All emails sent to your FigLeaf address are forwarded from our secure servers to your real address like magic. If the site you signed up at is ever compromised, your real email won’t be part of the data breach. And because your email and password are completely unique, you won’t make the mistake of using the same login details on multiple sites.

Connect privately — With your own private connection, all your web browsing is conducted through remote servers, hiding your activity and location from others. Your data is also encrypted so that it’s unreadable in transit. It’s perfect if you want to hide your location from others or need some real privacy on public Wi-Fi.

Autofill my login info — When turned on, all your emails and passwords saved in FigLeaf are automatically filled in on your favorite sites. On new sites, FigLeaf gives you a masked email and strong password to use — and then saves them in FigLeaf. So now, you can finally ignore that ‘Forgot your password’ link. FigLeaf remembers all your emails and passwords, including masked accounts created in FigLeaf and your existing logins. It’s a safe and private way to log in anywhere. And everything is always in sync, wherever you use FigLeaf.

Block trackers — FigLeaf checks all scripts on every site you visit. If FigLeaf detects a tracker, it blocks it, hiding your activity from ISPs and other companies. Trackers are designed to follow you online, learn your habits and interests, and feed you advertising. Block trackers if you don’t want others to know about your online activity, or if you’re tired of seeing ads for stuff you’ve searched for or sites you’ve visited.

Definitions

Billing month — a period of time for which a periodic statement of charges is rendered to the customer, starting on the same day of each calendar month;

Content Updates — certain Software that uses content that is updated from time to time;

Customer — may be either the legal entity (or other organization) that you represent and warrant that you have all right, power, and authority to bind such entity or organization to these Terms of Service or You as an individual.

Dark Web — FigLeaf lets you scan the “dark web” to see whether certain information associated with your Account may have been compromised. Dark Web is provided by a third-party partner, searches a constantly-updated database of breached data to find matches with emails associated with your Account.

Device — computer, mobile or other computing devices on which FigLeaf software can be installed;

Documentation — any Software packaging that accompanies these Terms of Service;

FigLeaf’s Website — webpage located at https://figleaf.com/;

Open-Source Code — components (including, without limitation, programs, applications, tools, utilities, libraries, and other programming code) that are made available from third parties under a free or open-source software licensing model and might be included in the Software;

Service Period — shall be the period for which the customer has obtained the rights to use the Software as described in the EULA and these Terms of Service from the Company or its licensors (“Service Provider”);

Software — Software shall mean the object code version of Figleaf software to which a user is provided access as part of the Services, including any updates or new versions. FigLeaf software is the multi-purpose solution for privacy protection that suites for all platforms, designed to protect all personal data from being hacked online. FigLeaf also makes it simple to set and manage all privacy preferences through a single user-friendly interface and protects your private data from leaking.

Technical Support — certain technical support features offered from within the Software or through email, phone, or chat (live chat), etc. as well support features with the refund issues;

Third-party Software or Service — Third-Party Services may be provided to You through FigLeaf’s Website or in the FigLeaf software. FigLeaf is not responsible for these services or data. You are responsible for complying with the terms of use of all Third-Party Services you access through the FigLeaf services.

Software Activation and Content Updates

You are authorized to use this software only if you are properly licensed. After the purchase, the software will automatically contact Figleaf to conduct activation to associate it with a certain user's Account. If activation fails, You should contact our Technical Support. You may also receive reminders to renew the license for the software.

FigLeaf continually strives to improve the usability and performance of its Software and services, so that You shall have the right to receive new features and versions of the Software as well as Content Updates that FigLeaf, in its sole discretion, makes available during Your Service Period. In order to optimize the Software and provide You with the most current version of it, You agree that the Software may download and install new updates and versions of the Software as they are made available by Figleaf in its sole discretion.

You may have the right to refuse the download and installation of the new updates and versions of the Software, however, in that case, FigLeaf does not accept any responsibility for further proper work of the Software and services.

Technical Support

If You choose to access the Technical Support the following terms shall apply. Any such Technical Support shall be provided in FigLeaf’s sole discretion without any guarantee or warranty of any kind other than any guarantees applicable under consumer laws in Your jurisdiction which cannot be excluded or limited in any way. It is solely Your responsibility to complete a backup of all Your existing data, software and programs before receiving any Technical Support.

FigLeaf will make an effort to provide you with email, phone and chat support pertaining to your use of FigLeaf Account and FigLeaf Website. The said support will be limited to topics within the domain of basic usage of FigLeaf Account and FigLeaf Website. In the course of providing the Technical Support, FigLeaf may determine that the technical issue is beyond the scope of the Technical Support.

Figleaf reserves the right to refuse, suspend or terminate any of the Technical Support in its sole discretion. Figleaf serves the right to cease offering support of any kind pertaining to the usage of older releases of the Software whenever a new release of Software becomes available (ex. when version 4 is published support for version 2 will end).

Acceptable Use

FigLeaf does not allow our website or Software to be used for illegal activities or activities that we find improper for any reason whatsoever. FigLeaf reserves the right to take preventative or corrective actions to protect ourselves and our users from anyone's unacceptable use. Your failure to comply with these Terms of Service may result in terminating your access to and use of our website and Software.

You agree not to:

  1. Impersonate anyone, falsely state or otherwise misrepresent your affiliation with any person or entity, or knowingly provide any fraudulent, misleading, or inaccurate information;
  2. Defame, abuse, harass, stalk, threaten, or otherwise violate others' rights, including without limitation others' privacy rights or rights of publicity;
  3. Access or use (or attempt to access or use) another user's account without permission
  4. Transmit any software or materials that contain any viruses, worms, trojan horses, defects, or other items or computer code of a destructive nature;
  5. “Frame” or “mirror” any portion of the website or Software;
  6. Use any robot, spider, site search/retrieval application, or other manual or automatic device or process to retrieve, index, data mine, or in any way reproduce or circumvent the navigational structure or presentation of our Site or Software;
  7. Harvest or collect any other users' information from the website or our Software;
  8. Use our website or Software for any illegal activity; or
  9. Probe, scan or test the vulnerability of our website or Software, breach their security or authentication measures, or take any action that imposes an unreasonable or disproportionately large load on our Website infrastructure.

Usage Policy and Prohibited Activities

The Software cannot be used for activities prohibited by the law.

To protect our Software from being misused, abused or being used to harm someone, we enforce some rules which apply to every Customer equally, regardless of the type of subscription. You specifically agree not to use this Software for:

  • Accessing/sharing/downloading/uploading illegal content, including, but not limited to, child pornography or content perceived to be child pornography;
  • Harassing, abusing, insulting, harming, defaming, slandering, disparaging, intimidating, or discriminating based on gender, sexual orientation, religion, ethnicity, race, age, national origin, or disability;
  • Sending or transmitting unsolicited advertisements or content ("Spam") over the Software, via email or any other communication channel;
  • Attempting to access, probe, or connect to computing devices without proper authorization (i.e., any form of “hacking”);
  • Infringing upon or violating our intellectual property rights or the intellectual property rights of others;
  • Promoting illegal activities, or providing means for/helping other people commit illegal activities by providing instructional information.

The account of any customer found involved in any of the aforementioned activities will be suspended immediately without notice. Additionally, You may be held responsible for any and all damages incurred by the Company, including any amounts charged by any outside entity due to said violation(s), including without limitation attorney's fees and costs.

Open-Source Software

The Open-Source Code components that are included with the Software are redistributed by Figleaf under the terms of the applicable Open-Source Code license for such component. Your receipt of Open-Source Code components from Figleaf under these Terms of Service and EULA neither enlarges nor curtails your rights or obligations defined by the Open-Source Code license applicable to the Open-Source Code component. Copies of the Open-Source Code licenses for the Open-Source Code components that are included with the Software are included with or referenced in the Software’s Documentation.

Termination

  • Termination by You

You may terminate this Agreement at any time by canceling a subscription or ceasing to participate in or access the Software.

  • Termination by FigLeaf

These Terms are effective until terminated. Without prejudice to any other rights, FigLeaf may immediately terminate these Terms if you fail to comply with any terms of this Agreement. In such event, you must cease all use of the Software and destroy all copies of it that are in your possession. Inaction of FigLeaf to terminate this Agreement after you fail to comply with any of the terms that are set out in this Agreement does not imply a waiver of any kind of the rights that are reserved by FigLeaf under this and other provisions.

Please note that if you purchase our Software through a third-party, like the Apple App Store, Google Play Store etc, terminations and refunds are subject to their respective policies.

FigLeaf values all feedback from customers and does everything to fix all possible issues. However, if you are still not satisfied with our Software and may require a refund — please study our Refund Policy.

Refund Policy

We are pleased to offer our active paid annual and monthly subscribers a “no questions asked refund” for payments made during the current term (month or year, depending on the type of subscription) in which a refund is requested. Refunds will be provided only to subscribers who request refunds during the term (month or year, depending on the type of subscription) they have made a subscription payment. For a 12 (twelve)-month subscription plan, a request for a refund is valid during the first 6 (six) months of the purchase. All other refunds, including refunds for past payments and one-time payments, will be issued at our discretion or pursuant to applicable law.

Refunds are given only in case of problems that are directly related to our Software. If there are direct proofs of issues with our Software (for example, error messages or screenshots), and our Technical Support cannot resolve these issues, You have the right to receive a refund. Refunds are not given in case of general computer problems that are not related to our Software.

If our Software becomes a reason for a technical breach of your device with enough evidence and proof on this matter, we may consider giving you a refund of the damage inflicted. After receiving a refund request concerning a technical infringement, our Technical Support require from 1 (one) to 3 (three) business days to give an initial response. After receiving all relevant evidence, our Technical Support require from 1 (one) to 10 (ten) days to process the received material and give a qualified response.

  • A. 12 (twelve)-month and 6 (six)-month subscription

According to this type of subscription, a partial refund is calculated proportionally based on the whole number of months remaining from the moment you have requested a refund until the subscription expiration date.

If you have made a refund request after the first 14 (fourteen) full days of the first or any subsequent month of the subscription period, we grant you a partial refund, covering only the price of the whole number of remaining months.

  • B. 30 (thirty) day money-back guarantee and a 1 (one)-month subscription

The guarantee is available to first-time customers who did not have FigLeaf’s Trial License activated. All returning customers or customers with expired Trial License are eligible for a partial refund calculated proportionally based on the number of days that remain from the moment you have requested a refund until the subscription expiration date.

If you have made a refund request within the first 7 (seven) full days of a billing month, we grant you a full refund covering the price of a 1 (one)-month subscription license.

The final calculation of the amount of money that is needed for a refund is carried out by our Technical Support; its details can be clarified by our Technical Support.

Before requesting a refund, the Customer must inform our Technical Support of any issues that may arise in relation to our Software. Refunds are given ONLY in case of contacting our Technical Support team by writing to support@figleaf.com. Our Technical Support is obliged to do their best to fix the problem. If they confirm that the software problem cannot be fixed, a refund will be given.

After submitting a refund request to our Technical Support, it will be reviewed and processed, unless a refund cannot be performed due to the terms and conditions that are set forth herein. In this case, You will be notified via email or phone as soon as possible.

If the Customer did not follow the instructions provided by our Technical Support, used incorrect setup, or refused to use our Technical Support service, FigLeaf has the right to decline the refund request.

Inability to download FigLeaf does not qualify You for a refund. You can have Internet or computer problems that are not related to our Software. If You are unable to download Software, You must contact our Technical Support.

After the refund is issued, usage of the FigLeaf features become inactive, and You can continue using FigLeaf Free.

Refunds are processed over a period of 1 (one) to 3 (three) weeks — the amount of time needed by the bank to process the payment. In case of a double charge due to circumstances beyond control, and if the fact thereof is confirmed, the Company is obliged to give the refund per Your request. All processing fees are non-refundable.

No warranty

TO THE MAXIMUM EXTENT PERMITTED BY LAW, FIGLEAF MAKES NO WARRANTY OR REPRESENTATION WITH RESPECT TO THE SOFTWARE, ITS QUALITY, PERFORMANCE, MERCHANTABILITY, OR FITNESS FOR A PARTICULAR PURPOSE. AS A RESULT, THE SOFTWARE SERVICES ARE PROVIDED “AS IS” AND YOU’RE ASSUMING THE ENTIRE RISK AS TO THEIR QUALITY AND PERFORMANCE.

You understand and acknowledge that FigLeaf won’t be liable for problems attributable to the operation of the Software. Some states don’t allow these types of limiting terms.

Limitation of Liability

You acknowledge and agree that, to the maximum extent that is permitted by applicable law REGARDLESS OF WHETHER ANY REMEDY SET FORTH HEREIN FAILS OF ITS ESSENTIAL PURPOSE, IN NO EVENT, WILL FIGLEAF OR ITS LICENSORS BE LIABLE TO YOU FOR ANY SPECIAL, CONSEQUENTIAL, INDIRECT, OR SIMILAR DAMAGES, INCLUDING ANY LOST PROFITS OR LOST DATA ARISING OUT OF THE USE OR INABILITY TO USE THE SOFTWARE EVEN IF FIGLEAF HAS BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES. IN NO CASE SHALL FIGLEAF OR ITS LICENSORS’ LIABILITY EXCEED THE PURCHASE PRICE WHICH YOU PAID FOR THE APPLICABLE SERVICE PERIOD. THE DISCLAIMERS AND LIMITATIONS SET FORTH ABOVE WILL APPLY REGARDLESS OF WHETHER YOU ACCEPT THE SOFTWARE. Some jurisdictions do not allow the exclusion of or certain limitations on damages and remedies. Accordingly, some of the exclusions and limitations that are described in this Terms may not apply to You.

Governing Law and Dispute resolution

The Parties mutually acknowledge and agree that this Agreement shall be construed and enforced in accordance with the laws of the State of California, United States of America, to the exclusion of the conflicts of laws provisions thereof. In the event any disputes, differences or controversies arise between the Parties in connection with this Agreement, the Parties shall thoroughly explore all possibilities for an amicable settlement. The sole and exclusive jurisdiction and venue for actions related to the subject matter hereof shall be the state and federal courts located in the County of Santa Clara, State of California.

Changes to Terms of Service

We work constantly to improve services and develop new features to make our Software better for You. As a result, we may need to update these Terms from time to time to accurately reflect our services and practices. Within the limits of applicable law, FigLeaf reserves the right, in its sole and absolute discretion and without notice to you, to amend, revise, update, change, modify, add to, supplement, or delete certain terms of this Agreement (hereinafter referred to as the “Changes”) at any time. You are responsible for regularly reviewing these Terms of Service by clicking the “Terms of Service” link either in the Software or FigLeaf’s website. If any future changes to this Agreement are unacceptable to you or cause you to no longer be in compliance with this Agreement, you must immediately uninstall the Software and destroy all copies of it. Continued use of the Software following any revision to this Agreement constitutes your complete and irrevocable acceptance of any and all such Changes.
